Communicating with the HOA Board:

Any question or concern directed at the Solimar HOA Board needs to go through the proper channels. Communicating with the Board can be done through in any of the following ways:

Most emails sent to the Board will be responded to, by the Solimar Secretary, within a matter of days for responses with which there is already clear precedent and/or readily available facts and information. When there are questions and/or concerns of which there is no precedent or no readily available clearly defined facts and/or information, the Solimar President, may need to respond.

Homeowner Compliance Standards & Maintenance Guidelines

The Solimar Board of Directors has the duty and responsibility to enforce the covenants, restrictions, and rules necessary to maintain, promote, and protect the value of our Community for the benefit of all members.

Thank you to all homeowners who consistently follow our covenants throughout the year and to those who have taken corrective action to resolve required remediations.

Exterior maintenance inspections and follow-up inspections are conducted throughout the year to ensure properties remain in compliance with our covenants.

I. Compliance Resources

A copy of the Maintenance Standards is enclosed on this page, along with FAQs regarding Solimar Vehicle Restrictions and certain safety-related items. Please review these documents.

Key Rules Requiring Attention

Below is information on common issues that may require your attention:

A. Front Yard Restrictions

Please take notice: The front yard area is not permitted for storage. No objects, equipment, or structures are to be placed and/or stored there. This includes, but is not limited to:

  • Storage structures or sheds
  • Play structures or inflatables
  • Basketball hoops
  • Barbecues or grills

B. Walls and Fences

  • Zero-Lot Line Walls: Homeowners are responsible for the maintenance of the exterior of all zero-lot line walls on their property. While the Board will not enter private property, the visible condition of these walls is inspected from the street and adjacent properties.
  • HOA Responsibility: Solimar paints and maintains the wall along Del Prado Circle. All other perimeter walls are the homeowner's responsibility.

C. Architectural Changes & Modifications

Any change to the outside of the house or yard must receive prior written consent from the Architectural Control Board (ACB). This applies to structural changes and exterior elements.

No homeowner shall erect, place, or alter any of the following items on any Lot without prior written consent:

  • Painting (color changes) or roof changes
  • Slabs or porches beyond the limits of any building or patio wall
  • Walls, fences, shades, screens, or awnings
  • Patio covers, decorations, signs, patios, balconies, or other structure or improvement of any nature.

II. Operational Standards

A. Garbage Cans and Recycle Bins

The core rule is that garbage cans and recycle bins must be stored within a walled-in area (e.g., inside the garage) and kept out of sight.

Collection Schedule:

  • Garbage cans and recycle bins may be placed out for collection no earlier than 24 hours before the day of collection and must be taken in the same day of collection (Mondays and Thursdays).
  • Yard waste/vegetation may be placed out no earlier than 24 hours before the day of collection (Thursdays).

B. Pet Control and Waste

Homeowners are required to comply with all relevant Palm Beach County Ordinances, which require pet restraint and waste removal in public spaces:

  • Leash Requirement: It is unlawful for any dog to be off the owner's property unless the dog is under the restraint or control of a person by means of a leash or other device. This applies to all common areas within the community.
  • Waste Removal: Owners are legally responsible for the immediate removal and proper disposal of all animal waste from any public or private premises, pavement, streets, parkways, or walkways. This includes all common areas within Solimar.

C. Signs and Flags (Per Article VI, Section 8)

The display of signs and flags is strictly limited by the covenants.

Signs:

  • Permitted: One sign of not more than one (1) square foot to indicate the name of a resident, or one sign of not more than five (5) square feet advertising the Lot for sale.
  • Required Removal: Any other sign (including those displayed for pride, causes, or schools) must be removed.

Flags:

  • A homeowner may display up to two portable, removable flags, not larger than 4 1/2 feet by 6 feet, ONLY as allowed in Florida Statutes Section 720.304.
  • If the flag does not meet the criteria in Section 720.304 of the Florida Statutes (linked below), it must be removed.

1.The United States flag. 2.The official flag of the State of Florida. 3. A flag that represents the United States Army, Navy, Air Force, Marine Corps, Space Force, or Coast Guard. 4. A POW-MIA flag. 5. A first responder flag. A first responder flag may incorporate the design of any other flag permitted under this paragraph to form a combined flag. For purposes of this subsection, the term “first responder flag” means a flag that recognizes and honors the service of any of the following: a. Law enforcement officers as defined in s. 943.10(1). b. Firefighters as defined in s. 112.191(1). c. Paramedics or emergency medical technicians as those terms are defined in s. 112.1911(1). d. Correctional officers as defined in s. 943.10(2). e. 911 public safety telecommunicators as defined in s. 401.465(1).f. Advanced practice registered nurses, licensed practical nurses, or registered nurses as those terms are defined in s. 464.003. g.Persons participating in a statewide urban search and rescue program developed by the Division of Emergency Management under s. 252.35. h.Federal law enforcement officers as defined in 18 U.S.C. s. 115(c)(1).

Non-Compliance and Enforcement Policy:

Maintaining community standards protects property values for all residents. While the majority of homeowners are compliant, consistent follow-through is necessary.

When a homeowner fails to complete required maintenance or remediation despite receiving violation letters, the matter must be escalated. In these cases of continued non-compliance with the Association’s covenants and official communications, the homeowner's account will be referred to the Association's legal counsel for enforcement action.

We encourage all homeowners to promptly address any compliance reminders received to avoid the expense and complication of legal enforcement.

Solimar Maintenance Standads - Exterior Property Elements:

All homeowners are responsible for maintaining their property's exterior elements in good condition according to the minimum standards required by the Solimar HOA covenants.

  • Roof: The roof must be kept clean, free of mildew, and in good repair. Any missing or broken tiles must be replaced immediately, and any new cement or sealant used must be painted to match the existing tiles.
  • House Exterior: The house must be kept free from mildew, dirt, and peeling paint, ensuring the exterior finish appears freshly painted.
  • Wood Trim/Vigas: Broken or sagging vigas (the wood beams over garages) and any other wood trim on side walls must either be repaired and painted, replaced entirely, or completely removed. If removed, the affected area must be patched, smoothed, and painted to match the house.
  • Walkways & Driveways: Walkways and driveways must be kept mildew- and stain-free. Pavement must be maintained without holes, loose debris, or chipped concrete/pavers, which must be patched immediately.
  • Garage Doors: Garage doors must be painted either Solimar Brown or a Board-approved trim color (See "Painting Rules"). When replacement is necessary, the new door must be a Board-approved design.
  • Mailboxes: Mailboxes must be maintained at the regulation height (42"–48"). Posts and boxes must be painted Solimar Brown or a Board-approved trim color (See "Painting Rules"). Replacement must be with a similar, Board-approved post and mailbox when necessary.
  • Atrium Wood Slats: Atrium wood slats must be painted Solimar Brown or a Board-approved trim color (See "Painting Rules"). They must be repaired/replaced with a Board-approved equivalent material OR completely removed.
  • Vegetation/Grass: All vegetation on the front or side of the house must be neatly trimmed and free of excessive weeds. Grassed areas must be properly maintained and healthy (green). Atrium vegetation must be kept trimmed below the roofline. All homes must have at least one regulation palm tree (Queen, Foxtail, or Cabbage palm with a 6' to 8' high trunk) and not more than four total palm trees in the front yard.
  • Screens: Porch and patio screens must be kept free of holes and rips and held firmly in place with splines.
  • Garage Carriage Lights: Lights may be replaced at the owner's discretion when necessary. The replacement fixtures must match the current style/color of the original fixture.

Solimar Vehicle Restrictions FAQs:

The following are NOT permitted to be parked in Solimar:

  • Mobile homes, motor homes, (campers, RVs, basically if it has a bed/cot)
  • Trailers of any description
  • Boats (including personal watercraft, aka jet ski, wave runner since they need to be on a trailer)
  • Junk vehicles (see definitions attached)
  • No boats, trailers. Not even if stored in garage

Safety and Security Reminders:

Sidewalk Use

The Solimar sidewalks were repaired in 2021. For the safety of all residents, please use the sidewalks when walking around the neighborhood. Walking in the streets of Solimar Circle significantly decreases safety for pedestrians and drivers alike.

Individual Carriage Lights

The individual homeowner carriage lights (the outdoor light fixtures on both sides of your garage) are not legally required to be kept on all night. However, keeping these lights turned on throughout the night can significantly improve safety and security for each of our homes, vehicles, and residents. Thank you for participating in this neighborhood security effort.

Fireworks Policy

Fireworks are a significant safety hazard and nuisance to the community.

Fireworks endanger our Solimar community, individual homes, persons, and property. The National Fire Protection Association (NFPA) notes that fireworks are linked to devastating burns, injuries, and fires . Fireworks started an estimated 19,500 fires in 2018, including 1,900 structure fires, 500 vehicle fires, and 17,100 outside and other fires.

Legal Definition and Restrictions

  • Definition: Florida law defines fireworks as any "combustible or explosive composition or substance or combination of substances…prepared for the purpose of producing a visible or audible effect," including firecrackers and Roman candles.
  • Legal Discharge Days: According to Florida state law, fireworks may only be legally lit on three days during the year: the Fourth of July, New Year's Eve, and New Year's Day. Note that some cities and towns may have further restrictions.

Pool Safety

The Keep Your Eyes on the Kids Project is a drowning prevention program that originated in Arizona and now exists in Florida.

This program designates one adult responsible for closely supervising children playing in and around the pool, spa, or any body of water for a specific period. The individual acting as the supervisor is identified with a visual marker, such as a "water watcher tag." This tag is simply a lanyard worn by the designated adult that clearly signifies he or she is responsible for supervising children's activities at the facility.

The individual formally transfers the lanyard, along with the supervising responsibility, to another person at the end of the period to ensure constant watchfulness.

The Power of the Water Watcher Tag
The water watcher tag (or any other obvious marker) is a powerful tool because:

  • It designates responsibility: It officially assigns one adult to watch the children. Many times, adults assume that someone else is supervising, when, in fact, no one is actively watching them.
  • It enforces transition: It reminds the designated "water watcher" that they must officially turn over the supervising responsibility to another adult through the physical transfer of the lanyard.

Adding a whistle to the lanyard provides an extra measure of safety, as it quickly draws attention to the situation and alerts individuals who may be some distance away.
