Dear Solimar Homeowner,

The Solimar board of directors has a duty and responsibility to enforce the covenants, restrictions, and rules that promote and enhance or protect the Community for the benefit of all members.

Thank you to all of our homeowners that follow our covenants throughout the year and also to those that have taken the corrective actions to resolve any required remediations.

Exterior maintenance inspections and follow up inspections are done throughout the year to ensure homeowners stay in compliance with our covenants. A copy of the maintenance standards are enclosed along with FAQ’s regarding Solimar Vehicle Restrictions and some safety related items. Please read these, thank you.

Below is some information on issues that may need your attention. 

Please take notice that your front yard, is not the place for any objects, equipment or any other structures. For example, no storage structures, play structures, inflatables, basketball hoops, barbeques or other any other objects or structures are not to be placed and/or stored there.

The zero-lot line walls need to be maintained. You don’t see the wall, but your neighbor does.  We won’t go onto your property to inspect the zero-lot line wall, unless invited by your neighbor, but we will pay close attention to what we can see from the street.  Solimar paints the wall along Del Prado Cir, but the other side is homeowner responsibility.

Please note that any changes to the outside of the house or yard must first be approved by the board, this includes  painting and roof changes, but it also applies to other things; no homeowner shall place any slabs or porches beyond the limits of any building or patio wall and no wall, fence, shades, screens, awnings, patio covers, decorations, signs, patios, balconies, porches, or other structure or improvement of any nature shall be erected, placed or altered on any Lot unless prior written consent is obtained from the Architectural Control Board. 

The following information address important information that all homeowners need to comply with:

Garbage cans and recycle bins:

The short version is that garbage (cans) and recycle bins need to be stored within a walled in area (ex: garage) and out of sight.  And garbage (cans), recycle bins are to put out for collection no earlier\than 3pm the day before collection and taken in the same day. Yard waste/vegetation to put out no earlier than 3pm the day before collection (Thursdays).

For those with animals the requirement and responsibility of the owner to remove “pick up” their animals waste “deposits”.

Signs/Yard Signs:  During inspections homeowners have been requested to remove signs but during the year additional signs have been displayed and these need to be removed, unless meets the below standard:

ARTICLE VI Section 8: Signs.  No sign of any kind shall be displayed to the public view on the Property except one sign of not more than one (1) square foot used to indicate the name of a resident, or one sign of not more than five (5) square feet advertising the Lots for sale

The board understands owners wanting to display their support and/or pride for various causes, schools,others etc; however, as per our Solimar covenants, no sign (or Flag, as per below) of any kind shall be displayed to the public view on the Property, except as described above and below, thank you in advance for complying.

Flags: During inspections homeowners have been requested to remove flags but during the year additional flags have been displayed and these need to be removed, unless they meet the below standard:

A homeowner may (still) display (a flag) in a respectful manner up to two of the following portable, removable flags, not larger than 4 1/2 feet by 6 feet, ONLY as allowed in Section 720.304 of the Florida Statutes, as per below. If the flag is not below, please remove it, thank you:

1.The United States flag. 2.The official flag of the State of Florida. 3. A flag that represents the United States Army, Navy, Air Force, Marine Corps, Space Force, or Coast Guard. 4. A POW-MIA flag. 5. A first responder flag. A first responder flag may incorporate the design of any other flag permitted under this paragraph to form a combined flag. For purposes of this subsection, the term “first responder flag” means a flag that recognizes and honors the service of any of the following: a. Law enforcement officers as defined in s. 943.10(1). b. Firefighters as defined in s. 112.191(1). c. Paramedics or emergency medical technicians as those terms are defined in s. 112.1911(1). d. Correctional officers as defined in s. 943.10(2). e. 911 public safety telecommunicators as defined in s. 401.465(1).f. Advanced practice registered nurses, licensed practical nurses, or registered nurses as those terms are defined in s. 464.003. g.Persons participating in a statewide urban search and rescue program developed by the Division of Emergency Management under s. 252.35. h.Federal law enforcement officers as defined in 18 U.S.C. s. 115(c)(1).

Dear Solimar Homeowner,

In the past, some homeowners were unresponsive to making the required remediations despite receiving letters and fines frustrating our neighbors that are making the efforts to be compliant. In the rare case of a homeowner(s) failing to comply with the Association’s covenants and communications and/or reminders for compliance, the homeowner(s) can be sent to the Solimar attorney’s office to enforce our Solimar covenants, so please address any reminders received to avoid this. Thank you in advance for your cooperation.

SOLIMAR MAINTENANCE STANDARDS:

ROOF: kept clean, replace missing or broken tiles, and paint any new cement to match tiles

HOUSE: kept freshly painted and free from mildew and peeling paint

WOOD TRIM: broken or sagging vegas (wood over garages) and wood trim on side walls must either be repaired or replaced OR completely removed and areas patched, smoothed and painted.

WALKWAYS/DRIVEWAYS: to be kept mildew and stain free. Holes and loose or chipped pavement must be patched.

GARAGE DOORS: painted Solimar Brown or Board approved trim colors (See "Painting Rules") or replaced with Board approved garage door.

MAILBOXES: regulation height 42"-48", painted Solimar Brown or Board approved trim colors (see "Painting Rules"), replace with similar post and mailbox when necessary.

ATRIUM WOOD SLATS: painted Solimar Brown or Board approved trim colors (see "Painting Rules"), replace with Board approved equivalent slats OR remove completely.

VEGETATION/GRASS: all vegetation either in front or on side of house is to be neatly trimmed and devoid of excessive weeds; all grassed areas to be properly maintained (green); atrium vegetation mustbe kept trimmed below roof line. All homes must have at least one regulation palm tree (Queen, Foxtail, or Cabbage palm with 6' to 8' high trunk) and not more than 4 in each front yard.

SCREENS: porch and patio screens are to be kept free of holes and rips and held firmly in place with splines.

GARAGE CARRIAGE LIGHTS: lights may be replaced, when necessary, at owner's discretion.

ARCHITECTURAL CHANGES: Any changes must be approved through written consent of the Board which includes paint colors and roofs.

SOLIMAR VEHICLE RESTRICTIONS FAQ’S:

  • The following are NOTpermitted to be parked in Solimar:

    • all trucks, not just commercial trucks(see page- Vehicle Restrictions)
    • commercial vehicles (see definitions attached)
    • mobile homes, motor homes, (campers, RVs, basically if it has a bed/cot)
     trailers of any description
     boats (including personal watercraft, aka jet ski, wave runner since they need to be on a trailer)
    • Junk vehicles (see definitions attached)
    No trucks, boats, trailers. Not even if stored in garage.

Some safety related items:

The Solimar sidewalks were repaired during 2021 so please use them when walking around the neighborhood as walking in the streets of Solimar circle decreases the safety for all.

Individual homeowner carriage lights, which are the outdoor light fixtures on both sides of your garage, are not required to be kept turned on throughout the night. However, keeping the light fixtures turned on the entire night can help improve the safety and security for each of our homes, vehicles and most importantly, our residents. Thank you in advance for your help with this effort. It is greatly appreciated!

Fireworks: not only are fireworks considered a "nuisance” by some they endanger our Solimar; community, individual homes, persons and property. “Despite the dangers of fireworks, few people understand the associated risks - devastating burns, other injuries, fires, and even death. Fireworks started an estimated 19,500 fires in 2018, including 1,900 structure fires, 500 vehicle fires, and 17,100 outside and other fires”

When can you light fireworks in Florida?

According to state law, Floridians can legally light fireworks on three days during the year: the Fourth of July, New Year's Eve, and New Year's Day. However, some cities and towns do not allow fireworks.

Fireworks are defined in Florida's law as "combustible or explosive composition or substance or combination of substances…prepared for the purpose of producing a visible or audible effect," including firecrackers and Roman candles.

Pool Safety

The Keep Your Eyes on the Kids Project is a program that
originated in Arizona and now exists in Florida.

It designates one adult responsible for closely supervising children playing in
and around the pool or spa (or any body of water) for a specific
period.

The individual is identified with some visual marker,
as a “water watcher tag,” which is simply a lanyard
worn by the designated adult that makes clear that he or she is
responsible for supervising children’s activities at the facility.

The individual formally transfers the lanyard, along with the
supervising responsibility, to another person at the end of the
period to ensure constant watchfulness.

The power of the water watcher tag or another type of obvious
marker is that:

It officially designates an adult to watch the children. Many
times, adults assume that someone else is supervising the
children when, in fact, no one is watching them.

It reminds the adult who is acting as the “water watcher”
that he or she must officially turn over responsibility for
watching children to another adult with the physical transfer
of the lanyard.

Adding a whistle to the lanyard provides an extra measure of
safety, because it quickly draws attention to the situation and
alerts individuals some distance away.
